1. Agreement to Terms

By accessing or using Gatefolded ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Gatefolded is a music sharing platform that allows artists to upload, manage, and share their music. The Service provides tools for creating shareable album pages, controlling access to content, and connecting with streaming platforms and social media.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

4. User Responsibilities

You agree not to:

  • Upload content that you do not own or have the right to distribute
  • Upload content that infringes on any copyright, trademark, or other intellectual property rights
  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Upload malicious code, viruses, or other harmful content
  • Share your account credentials with others

5. Content Ownership

You retain all ownership rights to the content you upload to Gatefolded. By uploading content, you grant Gatefolded a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service.

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not violate any third-party rights.

6. Subscription and Payments

Access to certain features requires a paid subscription. Subscription fees are billed annually in advance. All fees are non-refundable except as required by law or as explicitly stated in these terms.

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will apply to your next billing cycle.

7. Free Trial

We may offer a free trial period for new users. At the end of the trial period, you will be automatically charged the applicable subscription fee unless you cancel before the trial ends.

8. Account Termination

You may cancel your account at any time. We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

Upon termination, your right to use the Service will immediately cease. We may delete your content and data after a reasonable period following termination.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATEFOLDED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Gatefolded and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these terms.

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on the Service or by sending you an email. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
