1. Agreement to Terms

Gatefolded ("the Service") is operated by Gatefolded LLC, based in Washington State, USA ("Gatefolded", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Gatefolded is a music sharing platform that allows artists to upload, manage, and share their music. The Service provides tools for creating shareable album pages, controlling access to content, and connecting with streaming platforms and social media.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

4. User Responsibilities

You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In addition, you agree not to:

  • Upload content that you do not own or have the right to distribute
  • Upload content that infringes on any copyright, trademark, or other intellectual property rights
  • Upload content that promotes hate, discrimination, or harassment based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics
  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Upload malicious code, viruses, or other harmful content
  • Share your account credentials with others

5. Content Ownership

You retain all ownership rights to the content you upload to Gatefolded. By uploading content, you grant Gatefolded a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service.

You represent and warrant that you own or have the necessary rights to all content you upload, and that your content does not violate any third-party rights.

6. Subscription and Payments

After the free trial, keeping your pages online and editing them requires a paid subscription. There is one plan, and it includes every feature. Subscription fees are billed annually in advance.

You can cancel at any time. Canceling stops the next renewal; your pages stay online until the end of the period you have already paid for. We do not refund partial periods, except as required by law.

We reserve the right to change our pricing at any time. Any price changes will be communicated to you in advance and will apply to your next billing cycle.

7. Free Trial

We offer a 7-day free trial for new users. No credit card is required to start it, so nothing is charged automatically when it ends; you are billed only if you choose to subscribe.

If the trial ends without a subscription:

  • Your share pages and artist page go offline. Anyone opening their links sees a page-not-found.
  • You can no longer edit your releases.
  • You can still sign in to subscribe, export your data, or download your files.
  • If you have not subscribed 30 days after the trial ends, we delete your account and its files.

7A. Storage and Usage Limits

While we do not impose hard storage limits on uploaded content, we reserve the right to enforce reasonable usage policies to prevent abuse. "Unlimited" storage is subject to fair use, and the Service is intended for music sharing, not general-purpose file storage. We may contact you if your usage significantly exceeds typical patterns for music artists.

7B. Tip Collection

Gatefolded allows you to add links to third-party payment services (Venmo, PayPal, Cash App) for receiving tips from your listeners. Gatefolded does not take any percentage of tips you receive. All tip transactions occur directly between you and your supporters through your chosen payment provider.

You are solely responsible for any disputes, chargebacks, or issues related to tips received. Gatefolded is not a party to these transactions and has no liability for payment disputes.

8. Account Termination

You may cancel your account at any time. We reserve the right to suspend or terminate your account if you violate these terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

If a paid subscription ends and is not renewed, your pages go offline at the end of the paid period, as described in Section 7 for a trial, and we delete the account and its files 30 days after that. If you delete your account yourself in Settings, it is deleted straight away.

Upon termination by us, your right to use the Service ceases immediately, and we may delete your content and data. Deleted files may remain in private backups for a limited time before they are permanently erased.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATEFOLDED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Gatefolded and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these terms.

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on the Service or by sending you an email. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, and applicable United States federal law, without regard to conflict of law principles.
