DMCA Policy

1. Respect for Intellectual Property
Gatefolded respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to valid notices of alleged copyright infringement that comply with the DMCA and other applicable laws.
Gatefolded LLC is based in Washington State, USA.
2. Filing a DMCA Takedown Notice
If you believe that content hosted on Gatefolded infringes your copyright, you may submit a written DMCA takedown notice. Per 17 U.S.C. § 512(c)(3), your notice must include the following:
- Identification of the copyrighted work: Identify the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material: Identify the material you claim is infringing, including the specific URL(s) or other information sufficient to locate the material on our service.
- Contact information: Provide your address, telephone number, and email address so we can contact you regarding the notice.
- Good faith statement: Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: Include a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: Include your physical or electronic signature.

4. Counter-Notification Process
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the Western District of Washington), and that you will accept service of process from the person who provided the original DMCA notice or their agent

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10-14 business days that they have filed a court action, we may restore the removed content.
5. Repeat Infringer Policy
Gatefolded maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. Users who receive multiple valid DMCA notices may have their accounts suspended or permanently terminated.
6. Misrepresentation Warning
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
